First, there is an open question as to whether the activities he is being impeached for had to have occurred since the last election, or since he was elected to the office he now holds. That is a question that has to be resolved. Since impeachment is a political act and not a criminal prosecution, that question will probably be resolved by the Legislature itself. The court will probably not get involved in an impeachment due to separation of powers.
Second, I never claimed to have any evidence one way or another. Quite to the contrary, I was very clear about my position, which is that I needed to see more evidence before I came to any conclusion. Probably a wise course of action for everyone who doesn’t have direct knowledge of the evidence…
