The popular video app TikTok sued Montana on Monday, saying the state’s new law banning the app statewide would violate Americans’ First Amendment right to free expression.
The federal lawsuit will set the stage for a broader debate over the short-video app and its Chinese parent company, ByteDance, which some critics in the United States have said is vulnerable to Chinese government propaganda and espionage.
The lawsuit seeks to overturn the law, which Gov. Greg Gianforte (R) signed last week and is set to go into effect Jan. 1. The legal challenge will probably delay the measure.
Gianforte said the law would “protect Montanans’ private data and sensitive personal information from being harvested by the Chinese Communist Party.” Neither Montana officials nor the U.S. government has supplied evidence supporting that claim.

The first amendment mentions nothing about allowing an app which is designed to monitor and spy on people. In fact, TikTok acts as a foreign agent, gathering and sending information to the enemy, that being China, and China does not have the same rights in the U.S. as all American citizens. TikTok is out of line.
It’s not only about the 1st Amendment, though that’s obviously how these Chinese wolves using our Constitutional virtues to dress themselves.
But it’s really about the Chinese trying to infiltrate US culture via that cracked-open door of our virtues, isn’t it?
Everybody gets free speech, but you gotta leave all the China-abetting metrics, spying and recordkeeping out of it.

I got angry when Jimmy Carter said Taiwan was part of China in 1978.
Now our government is clearly going back on that notion to provoke China.
Our leaders are hypocrites since Reagan and the Bushes, Clinton etc. didn’t deviate from Carter’s standard.
It’s just been decided in recent years at the end of Trump and beginning of Biden to go in the new direction that Taiwan isn’t part of China anymore.
I don’t think we have one in this country in certain cases like when a certain laptop was being discussed in October of 2020 while Trump was POTUS no less.
If Zuckerberg and the U.S. Congress is against TikTok, I’m for TikTok, even though it is owned by the Chinese Communist Party.
The U.S. Constitution is not a suicide pact.
Bravo to TikTok for challenging this absurdity. Montana has no legal basis, standing, nor means of enforcement. Now it’s TikTok. Next would be WeChat. By the time they get to Free Republic it will be too late.
Based on the most recent SCOTUS rulling supporting cali being allowed to ban pork if it doesn’t follow their standards, I suspect TIK TOK will lose. They said voters in states can choose what they want to allow and not allow.
The good thing about our youth is that they refuse to use Zuckerberg's crappy social media sites. They're using SnapChat and TikTok and other alternatives out there.

So go blow if a state wants to block Tick Toc, The ship called 1st Amendment has already sailed.
First amendment doesn’t apply here. The right to free speech is not being abridged by the banning of TikTok. People have all sorts of avenues to exercise their right outside of TikTok.
The most amusing part is …. Its china…. Is there such a thing as free speech in China?
