They have no authority over his declass authority, period.

If Trump's statements are accurate, Trump did nothing wrong and was complying with the feds during inspections, but he is still going to lose on this one, and in a DC court, we all know how that will play out.

Yes, it's BS, but as far as we know, there's no memo or documentation that memorialized his blanket declassification decision, and he never released the supposedly declassified files to the public, which means they could be easily reclassified and reclaimed by the government by a successor.

If Trump had a staff that actually took care of him, his decisions on declassification upon movement to Mar a lago would be diligently recorded and memorialized to prevent, or at least stave off prosecution for exactly what has happened.

Even if all of the classification stuff were swept under the rug because it's executive authority, the declassified documents would still be government docs and fall under FOIA, which is outside presidential purview.

Classification is a red herring.

the issue under the Presidential Records Act is that these documents belong to the American people, not to the President. Unless they are private papers and the Archivist has agreed that they are, Trump should not have had them.

. Under the PRA, the official records of the President and his staff are owned by the United States, not by the President.

The Archivist is required to take custody of these records when the President leaves office, and to maintain them in a Federal depository.
