If you believe you ARE winning, but you also suspect that the judge believes so too and is doing everything he can to tilt the case the other way, then a request like this is setting up a basis for appeal later.

Not true. Trump’s attorney is preserving these points for the appeal. If he doesn’t raise them during the trial he would automatically lose that point in an appeal.
Has nothing to do with if he thinks he is losing during the trial. Based on his cross-examination, I think he is winning.
