Anyone can sue any federal agency over the “science” it makes up to promulgate bureaucratic rules. The legislation to sue federal agencies over “rules” was passed by Congress and signed into law by Bush.
If the rule doesn’t pass the science test, it must be rescinded.
Of course this requires that people get up off their fat asses and sue the agencies.
