I don't know much about this stuff but IIRC in order for a state law to be overturned by the federal courts an actual lawsuit must be filed in Federal court challenging its constitutionality,detailing the reason for the challenge.

Federal lawsuits are expensive,difficult and time consuming.

We have groups here in CO that are funding and bringing these suits. RMGO has been pretty aggressive and has made it very expensive for some local governments in the past year. Plus, they have won.
