The Shaky New York Case Against Trump Reeks of Desperation To Punish a Reviled Political Opponent
Reason ^ | 31 Mar 2023 | Jacob Sullum

Manhattan District Attorney Alvin Bragg is relying on debatable facts and untested legal theories to transform minor misconduct into a felony.

The New York indictment of Donald Trump, which won't be unsealed until he is arraigned early next week, reportedly includes "more than two dozen counts." That's a surprisingly large number if the case is based entirely on the $130,000 that Trump lawyer Michael Cohen paid porn star Stormy Daniels in 2016 to keep her from talking about her alleged 2006 affair with Trump. The litany of charges reinforces the impression that Manhattan District Attorney Alvin Bragg, a Democrat, is trying to justify this belated and dubious prosecution by transforming minor misconduct into a case that looks serious until you consider the underlying allegations.

According to reporting based on anonymous sources close to the investigation, Bragg is relying mainly on a state law that makes it a misdemeanor to falsify business records "with intent to defraud." Trump, who reimbursed Cohen for the hush payment to Daniels, allegedly broke that law when his business misrepresented the reimbursement as payment for legal services under a nonexistent retainer agreement. If the Trump Organization recorded the payment in more than one document, those records could be the basis for several counts under this statute. But each of those counts would still be a Class A misdemeanor, punishable by a maximum fine of $1,000 and/or up to 364 days in jail.

Indeed he is, but what are we going to do about it?

“Indeed he is, but what are we going to do about it?”

We don’t have to do anything. Trump is very rich and can hire the best lawyers in the country. If the case is as weak as many claim, the charges will be beaten in court. Besides, we learned from what happened to the J6 protestors to keep ones distance.

“The charges will be beaten in court...”

~~~~~~~
In THIS handpicked prosecutor’s handpicked judge’s handpicked jury’s court?
Irrelevant. The process is the punishment.
It’s Election Interference, and Treason.
If we let them continue to get away with this wildly and perversely
unconstitutional behavior, no different than the FISA Corruption, the bogus J6
committee and the two bogus impeachments, hiding the hunter laptop and the
Biden family payoffs from China... Well good luck to all good souls guilty of
waiting until it becomes too late for anyone else to dare call it Treason...
Not my fight. I’m not going to end up abandoned and left to rot in prison like some of the J6 protestors.
On the bright side Trump will use this charade as even MORE free billions of in kind contributions from his opponents. Every single liberal propaganda media is TRUMP TRUMP TRUMP 24/7, like it was in 2016. I have a suspicion the democrat party is going to regret Alvin Bragg’s decision to indict Donald Trump. Imagine if the show trial is televised. NON STOP free publicity for Trump to drown out anything chomo Biden has to say. This is the only other thing the chomocrats have aside from their love of degenerate child grooming pedo trannies.
Yet the judiciary is so politicized and biased in Democrat run New York state, there is not one judge who has the courage to throw out this case based on the bias and announced, open political aims of the Soros prosecutor. The judiciary is corrupted further destroying the common consensus of values and faith in institutions that once united Americans. The foundations of the American republic are rotting.
All this is is the liberals trying to incite dislike or fear of Trump using the media and their lies.
For what he is being charged with, even if Trump is convicted, the charges against him won’t disqualify him from the presidency, legal experts tell TIME.
https://time.com/6267458/can-trump-still-become-president-indictment/
So this is nothing but a slander technique and not a criminal case. Personally, he ought to counter sue them for trying to slandering his livelyhood. Goose/gander.
“ Trump, who reimbursed Cohen for the hush payment to Daniels”
I am not sure this is a factual statement. We have a letter written by Cohen himself that denies he was reimbursed so how can Trump be involved?
It seems like that fact alone brings reasonable doubt to the case.
I don't have a lot of confidence in his lawyer-hiring skills.
Yes, but will he? Michael Cohen, Esq. wasn't exactly a keeper.
Last I heard there is something like 32 counts, I guess they figure if they can’t get him on something that “SOUNDS JUICY” they will go for something like he called Stormy a whore or he spit on the sidewalk.
I remember the main stream media saying that Cohen was mad at Trump because he didn’t reimburse him. Comics even made jokes about Trump not paying all his lawyers. So either Trump reimbursed Cohen or Cohen complained about Trump and his lack of payment. Both can’t be true.
