Was it an assault rifle or a defense rifle? If it's a real, select-fire M4, BATF would call it a "machine gun".
(If State Troopers are equipped with select-fire M4s and keeping them in their patrol cars, that would probably be the easiest way for a bad guy to acquire one.)
