A grand jury has 23 members. In order to conduct any business - hearing evidence or deliberating - a “quorum” of at least 16 grand jurors must be present. In order to make a decision, at least 12 grand jurors who have heard the essential and critical evidence and also the legal instructions must vote.

Doesn’t the Grand Jury indict, then he gets a trial with 12 jurors?

If a grand juror has untruthfully answered any question, or is found to have conflicts of interest that compromise her, those can be made known at any point in the grand jury process, even after a referral.

Furthermore, it is a violation of Federal and NY State law to lie to a grand jury. Gonna cost the Rat 5 years in the Fed.
