Former Vice President Mike Pence plans to challenge a subpoena issued by the special counsel overseeing the investigations into former President Donald Trump, according to two people familiar with his plans.
The sources confirmed that he intends to claim legislative privilege, mounting the argument that because he was president of the Senate as vice president, he was a member of the legislative branch and should be shielded from Justice Department questioning under the Constitution's "speech or debate" clause.
Under the clause, members shall "be privileged from Arrest during their Attendance at the Session of their respective Houses, and in going to and returning from the same; and for any Speech or Debate in either House, they shall not be questioned in any other Place."

The constitution supports his position. I used to think that was all that was needed. I suspect that this will be fought all the way up to SCOTUS as the DOJ under Biden will fight ANY reduction or restriction on the DOJ to conduct “investigations”.
Well, it’s an interesting legal theory. A constitutional footnote that deserves to be filled in sometime. I’m guessing over the past 240 years there have been a few legal tests of the limits of the speech and debate clause as applied to Senators and Congressmen. Wouldn’t surprise me if there had been no cases testing whether it applied to VP’s Senatorial function. Might have been some as to the limits, if any, of VPOTUS ‘executive’ privilege vs. POTUS ‘executive’ privilege. Presumably whatever rights Pence gains here would also apply to any theoretical future House Speaker who was chosen from outside the elected House membership.
And the shame is that the courts will be looking at this alleged VPOTUS power rather than the VPOTUS power which John Eastman had outlined, but which Pence had refused to try. Eastman’s case sounded strong to me and had it been tried we might have been spared all the Biden misery.
Kind of hard to do since classified documents were found in his possession after he said in a national interview that he had none.
It bears repeating that Pence’s staff were largely made up of Never-Trumpers. How that happened is a mystery other than to explain that DC had cultivated a large Cadre of leftist ideologues during the 8 years of Obama who were pre-qualified with suitable CVs and background clearances.
Under Obama, massive federal government agencies were purged and replaced with leftist ideologues.
While VP, Pence’s Chief of Staff was Marc Short, a rabid Never-Trumper who was tied to and took favors from the Trump hating Koch Brothers. The Koch’s are all about cheap labor, open borders.
The key detail to know related to the Special Scumbag Jack Thug’s subpoena, is it wants Pence on record for the Friday and weekend preceding January 6th that Pence was being drawn into the planning for “overturning” the 2020 election.
Indeed, Pence was all-in to join in the constitutional process of hearing objections and evidence against certifying Electors. This is an authorized legal process with historically drawn protocols and conditions. Pence was in the press as fully ready to engage in hearing and questioning objections. But in the final hours, he reversed himself or more precisely, he was reversed.
Pence was sat down in his VP office and told that if he allowed the objections to go forward with hearings and evidence, that he would be subject to charges associated with attempting to “overthrow” an elected government. The two persons sitting Pence down to coerce him were DC lawyers who come from the permanent administrative state.
Thus, Pence was intimidated, became scared and crawled into the coward shell space of his character.
Those involved in the Coup d’Etat of President Trump got DC gangsters with law degrees subsidized by laundered sinecures to “visit” Pence to project their own overthrow role onto Pence making him think in jiu-jitsu psycho-politics that it would be him, Mike Pence, participating in a Coup d’Etat of their CCP compromised criminal puppet that currently occupies the White House, if he allowed the objections to play out with an interim postponement of 10 days for state legislators to collect more evidence. Much of this factual narrative has been lost and buried by the BlackRock controlled media.

The coercive projection onto Pence was carried over to January 6th protesters who walked peacefully to the Capitol building to continue their protests which they had the constitutional right to do, only to be drawn into a false flag staged “Insurrection” led by undercover FBI operatives and Antifa anarchists wearing red MAGA hats.

What we as Americans need to get clear on is that January 6th was a setup.
Congress is now on track to bring in the real January 6th ringleader who is none other than Nancy Pelosi, to answer for her deliberate role in denying security protections for the Capitol Building and all the DC Mall. We should not be surprised to see a war or wars deter the investigation and questioning of Nancy Pelosi and others involved in staging the January 6th incident.
As a consequence of the planned false flag setup, hundreds of innocent protesters were arrested for “Criminal Trespassing.”
As part of the hearings of objections to certifying certain Electors, state legislators were scheduled to speak before the joint body including the scheduled and invited appearance of President Trump.
