Texas Dad Richard Acosta Convicted of Murder in Fatal Shootings by Teen Son

A Texas man has been convicted of capital murder in the fatal shooting of three teenagers by the man’s then-14-year-old son.

Richard Acosta, 34, was convicted Friday by a jury in Dallas of capital murder for the 2021 shooting deaths of Xavier Gonzalez, 14; Ivan Noyala, 16; and Rafael Garcia, 17, the day after Christmas. A 15-year-old newly hired cook was injured in the shooting and has recovered.

Acosta testified that he did not know his son, Abel Acosta, had a gun or had shot anyone, only that the teenager got into his vehicle and told his father to drive away because someone was shooting.

What am I missing? Why is the father being convicted of murders that his son committed?

He was an accomplice - including driving the getaway. Felony Murder Rule - all accomplices are as guilty as the one who pulled the trigger.

Every time a murderer is too young to be charge as an adult, they should always charge both parents with murder.

This one is a bit raw. He was in effect an “Accomplice by Deception”, having no complicity before, during, or after the fact *to his knowledge*.

I suspect his son has fled to Mexico. Probably on I-35 to Nuevo Laredo. About 450 miles. It all depends on how many family he has there.

Anyone who assists in a murder is guilty of murder, not just in Texas, everywhere.

Always? Pretty broad statement. And I disagree. Maybe sometimes, but not always.

He’s being convicted because they need to blame someone. And it appears that he is guilty … of being a dumbass. Unless he knew what his son had done he’s no more guilty than a driver would have been if his son carjacked someone.
