Reports in January 2021 just say he was wanted for walking around with the battle flag, not that he “menaced” anyone with it. I suspect they just made that up.

“What is the actual difference between a confederate flag and a confederate battle flag?”
The term “Confederate Flag” could possibly refer to any of several official flags used by Confederates.
The Confederate battle flag usually refers to the one dominated by St. Andrew’s Cross.

Waving a flag around is a 1st amendment right. No matter what flag.
Menacing is mostly subjective unless there was was some kind of assault.

I don’t do drugs. How the hell do you “menace” an “officer” with a Rebel flag? It’s sounds as though the “judge” was menaced also and now needs to see a shrink. He said he can’t believe someone would take a Rebel flag in that sacred outhouse known as the House on The Hill.
