While I agree with most of the comments, mere trespass is not grounds for using deadly force in most states (although it should be).

It should be in the southern border states, given the history of the people that enter here.

A 73 year old man alone with his wife on an isolated ranch at night next to a neighboring country run by violent cartels. I would shoot and take my chances with the legal system. I would rather be judged by 12 than carried by six. If it had been my wife she would have been providing covering fire.

From article:
“But under Arizona law, deadly force is allowed on one’s own property if the homeowner believes it ‘immediately necessary’ to prevent trespassing.”

Illegal aliens crossing ranches in that area shoot at ranch people routinely.

Fifty years ago I was routinely in small firefights with them on a ranch East of theirs. They would shoot at ranchers because they thought it was a way to scare us off.

It will come out likely that Kelly was under threat.

It’s way worse now then half a century ago. Now the heavyweight smuggling operations have way more firepower and wear tactical gear. A routine crosser like the guy who got shot may have just been a pathfinder clearing the route for a larger group and have been armed.

I dunno. They are committing a federal felony are they not?

How does the Rancher know what this “FEDERAL” felon was going to do?

Age 73 versus age 48.

How about self defense claim?

here is the listed legal description:

Trespass is generally when a person knowingly enters or remains on a piece of property after they have been requested to leave.

That's a damned good law and it should be enforced precisely. Arizona has a good reputation regarding conceal carry, open carry etc., at least as I remember. Frontier carryover...

Mere trespass is not grounds for using deadly force in most states .

Yet this farmer had encountered tresspassers before, and seemingly was aware that he COULD repell trespassers since he had called to them, cautioned them, ordered them to STAY OFF.

Arizona authorities seem to be changing the rules as quickly as they can manage.

Arizona USED to be a place where you could count on making a stand.

The hell with them. The day will come when they will plead to have the Mexican boot off their chickensheeite necks.
