Well you know what the Az law is right? The cows have right of way even if they get through a fence. The Rancher is not obligated to keep them fenced. They only do it to prevent too many losses. Legally if you hit one no matter where it is you have to pay the Rancher for that Cow if he chooses to charge you for it. And Cow laws are also why all the “undeveloped” back roads are universal as a 45 mile an hour zone. These laws go all the way back to Open Range laws. All the rancher has to do is make sure a “Cow” sign is up.

What will happen is he will end up in federal court defending the open range law that was put in back in the 1800s.

Sad thing is, he could at least make an attempt to prevent problems like that.

I dont have a problem with open range along outlying areas away from main highways. I DO have a problem where the speed is 65 and fences are in such poor conditions that cattle wander out into a major highway and get killed and could kill drivers and their children for no other reason other than he is irresponsible.

Funny thing, they dont seem to have any trouble like this up around Flagstaff etc.
