She might not be at fault, but the buck stops with her. She will be named in a civil suit, and the usual issues will be raised such as negligent hiring, failure to train, and failure to supervise.
One other thing. This is a classic case which could be filed in Federal Court for violation of civil rights under color of authority. And since this a homicide, this case should be death penalty eligible.
