Sure, they haven’t spoken to them yet, but we’re just speaking of possibilities. If the government wanted to question them for the relevant information, they could make that inquiry, and if the reporters refuse to answer, then any federal judge can compel them. The precedent has already been set.

It’s an interesting theory. If true, then they may want this all to go away because there’s not much to be done about it. They can’t kick her husband off the court if he didn’t do anything, and they can’t force them to get divorced. Can they even go after her for leaking, if she’s not a government employee? These may have been confidential documents, but they weren’t exactly classified for national security purposes so those laws don’t apply.

Pardons to Kwame Kilpatrick, Rod Blagojevich, various Wall Street crooks and swindlers, and a bunch of black drug dealers.
