You would have to find there was criminal intent, not hard, but it's a hurdle that would take an actual charge to test. And no one here actually believes Delaware is going to charge anyone named Biden with anything.
The way this Hunter Biden mess could have been handled was for Hunter to plead guilty in a plea deal that covered all crimes up to the date on the plea.
