If they strike now that Congress has passed their imposed contract, it will be considered a Wild Cat strike (I heard this mentioned on the radio yesterday).

In the United States, wildcat strikes have been considered illegal since 1935. Trade unions have the power to bargain collectively on behalf of their worker-members and call for strike action demanding concessions from employers.

Under the 1935 NLRA (National Labor Relations Act), federal courts have ruled that wildcat strikes are illegal, and that employers have the right to dismiss workers who participate in them.

I understanding that. I’m not a union guy, but I am totally against government being involved in business or labor. My mind can be changed if someone points me to the part of the constitution that gives government the power to engage in labor relations. Congress needs to be put into its place. And in this instance, it seems that labor has a legitimate grievance. Let labor and business fight this one out and both should tell government to pound sand.

Teachers wildcat strike all the time even though they aren’t supposed to and they are never held accountable for doing such.

What is Biden going to do? Fire them like Reagan fired all of the air traffic controllers that were part of PATCO?

Railroad and Airline unions are governed by the Railway Labor Act of 1926(RLA). It is quite different in that contracts never expire. They just become amendable.

No union governed by the RLA can strike unless it is approved by the National Mediation Board (NMB). Even then it may be delayed by 60 days through a Presidential Emergency Board (PEB).

The three members of the NMB are presidential appointees. One is an Obozo appointee, one a Bidone appointee, and the third a Trump appointee.

The D’s owned this strike. All Bidone’s PEB did was push it out past the midterms.
