This leads me to believe that those filing suit are either making an odd admission that the supposedly “affected minorities” really are incapable of passing a test that any human with enough brain to be a fireman or police officer ought to be able to pass with their eyes close... OR

They are racist towards themselves - wrongly believing that minorities are not smart enough to pass said tests.

It's right in the article-- "disparate impact". That means that minorities perform more poorly on the exam than whites, so that in itself proves it is racist.
