Time is now for Congress to act on DACA

Unconstitutional acts don’t become constitutional because you like the results. That’s why Congress, not the president, needs to give legal status to illegal immigrants brought here as children.

[In October] the 5th U.S. Circuit Court of Appeals ruled a Texas federal judge correctly found that the Deferred Action on Childhood Arrivals is unconstitutional. Barack Obama unilaterally created DACA in 2012. The program grants certain protections to those who came to the United States illegally as children. Eligible participants can receive work permits and protection from deportation. U.S. District Judge Andrew Hanen has since allowed the program to continue for those already enrolled while the case continues.

These children grew up in America, learning the language and culture. They went to school here and work here. In many cases, they’ve become productive members of society and are a benefit to their communities.

But living in a country with the rule of law means politicians have to follow the rules. Even Mr. Obama acknowledged that repeatedly. In reference to enacting new immigration policies without Congress, he said in 2010, “I am not king. I can’t do these things just by myself.” In 2011, he said that with “respect to the notion that I can just suspend deportations through executive order, that’s just not the case.” Later that year, he said about bypassing Congress to change immigration law, “That’s not how a democracy works.”

Facing a tough re-election campaign in 2012, he changed his tune and enacted DACA on his own. In 2020, Chief Justice John Roberts stopped Donald Trump from ending the program, saying he didn’t follow the steps laid out by the Administrative Procedures Act. Ironically, neither did Mr. Obama. Chief Justice Roberts’ decision appeared to be a way to save the program without ruling on its constitutionality.

Since then, Justice Amy Coney Barrett has replaced the late Ruth Bader Ginsburg, a liberal justice. It may take a while, but the Supreme Court is likely to rule — correctly — that DACA was unconstitutional as imposed.

But that’s a judgment on how the program was put in place, not on its merits. Giving DACA recipients permanent legal status is compassionate, fully justified and supported by the vast majority of Americans. Congress should act to do precisely that before the court strikes this program down.

I'd add a bar to those committing crimes in the US and allow a lengthy eligibility for a green card, no direct path to citizenship. It's a problem which needs resolution, Joe can always veto it.

I'd also add a worker program with no special path to a green card and a requirement of both a job and medical insurance. Yes, I know some employers might cheat on the lack of availability of workers just as some cheat on the employment of illegals. The solution to that is going after said employers.

This doesn’t make it to the top 100 on my list of things Congress should do...

I feel bad for anyone brought as a child, but their parents created the situation.

Until you close the border, this crap will continue to happen.

Giving amnesty communicates that if you break the law, you can become legal.

First, DACA is clearly UNCONSTITUTIONAL.

Second, any law that gives “DACA Recipients” citizenship should also allow children of bank robbers to keep the stolen money. Because….., well just because it’s not their fault so they should be allowed to benefit from their parent’s crimes.

Among my many issues, the main one I have is...how do we PROVE they were brought here illegally, against their will? Anyone could claim they were brought here illegally and now they can stay?!?

More importantly, if I steal a million dollars and give it to my kids, and when I am caught they don't let my kids keep the money! As a matter of fact, my kids can be charged for possession of stolen goods!

The bottom line is, this is nothing more than a BULLSH..TUFF work-around of our current, duly enacted immigration laws. Allowing these people to skirt the laws, which is what this new law would permit, would be an ex post facto law!! It too would be UNCONSTITUTIONAL!

THE LAW WAS NOT FOLLOWED - PERIOD!
GO BACK AND FOLLOW THE LAW - PERIOD!

No felonies or high misdemeanors. Not on government welfare or any program that government pays out money for them. DACA recipient and offspring can never be US citizens. These are the rules that legal immigrants have to follow. Illegal invaders, whether brought by parents or not, don’t get a special ride. Any legislation should have money for enough people to make sure the rules are followed. None of this “there are not enough people to track.” We live in a digital age. If they can track people who are spreading “disinformation,” they can track people in a DACA system.

Yes, turn it down once more and deport these illegals AND their families. Remove their work permits, prosecute them and employers if they work.

I’d add hay and water bottles in the boxcars taking them to the Mexican border, and revocation of citizenship for anyone who hired any of them, ever.

So I would say we don’t see eye to eye on this one.

My problem with DACA is that if you give them citizenship, they can sponsor their parents for it as well. People who broke the law.
