Supreme Court justice reverses part of NY absentee voting law (GOP win)

A state Supreme Court justice issued a split decision Friday finding that New York’s absentee ballot laws are partly unconstitutional, a decision that would affect an element of chaos in a midterm election that includes mail- These voting are already going on.

State Supreme Court Justice Diane L. Freestone’s decision halted the reversal of a change to election law that allows someone to vote by absentee ballot if they fear contracting COVID-19, a measure he has been highly criticized but said this would not help. Time cannot be undone.

His decision on a lawsuit filed by Republican and Conservative Party leaders is expected to be appealed by Democratic officials and ultimately resolved by the state’s highest court.

Freestone’s decision struck a chord with a 2021 state law around the “promotion” of absentee ballots. This includes the ability for election commissioners and vote watchers to challenge the validity of an absentee ballot, as if it were properly filled out or signed by the voter. Last year, a change in election law led by Democrats narrowed down the reasons for putting the ballot out.

To allow litigation in the future, absentee ballots would need to be preserved, the justice ruled. Ballot challenges often occur when a tight race is decided by absentee votes, inviting additional scrutiny in the process. Recent high-profile cases include presidential elections in 2000 and 2020.

of course they will ignore the ruling, and then claim they can’t just throw out 1,000’s of peoples votes and we’ll get around to fixing this NEXT time.

Supreme Court in New York is the first, lowest level of state courts. Next highest is the Appellate Division. What other states call their Supreme Court is known as the Court of Appeals in New York.

This is just the first step, not a binding state ruling.

Yes. A voting fraud sanctuary state.

Maybe solved by Soros company white vans pulling up to each home and taking ballots to hand carry back, on Scout’s Honor that they’ll do it without cheating.

This except does not at all clarify what the judge didf.

Please answer this:

Does the judge's ruling enable one wo fears gdetting the virus to vote by mail rather than physically going to his/her polling place, or does it stop it?

You should make that judge's decision clear either by selection of an excerpt, or through your comment Post #1. To me, you have left it completely confusing.

Even this part of the original extremly poorly written article is confusing:

Freestone has characterized the new rules as allowing anyone for fear of contracting COVID-19 by absentee ballot is illegal under state law. But he said the current precedent on that part of the election law prevents him from eliminating the excuse to vote by mail.

(1) Does the judge allow the mail-in ballot to be accepted because the voter fears infection by going to the polling place, or not?

(2) By his decision does the voter's actual appearance at the polling place on election day eliminate the mailed ballot. or not?
