The 1A protects you against the government when it comes to free speech. It does not protect you against private individuals.
So, for example, I can say all day long that I think Joe Biden is a pedophile. Biden is a government official. The 1A protects me. But if I say the same thing about my neighbor down the street, I can be sued for damages. And then a jury will decide.
Yes, and the other thing is, he didn’t just state opinions. It’s very hard to sue someone for slander over a statement of opinion. Jones made claims of fact, and those are much easier to sue people over, since you can prove or disprove a claim of fact in a court of law.
He didn’t slander or libel the character of anyone, so that is off the table. Free speech doesn’t mean it is constrained to ideas that don’t offend, no matter how idiotic they are.
