"A new policy was implemented last week by the FBI’s National Instant Criminal Background Check System (NICS), which seeks to collect the addresses of gun purchasers in a bid to comply with new federal law.
Federally licensed firearms dealers (FFLs) will now be required to provide the FBI with the personal addresses of individuals who attempt to make a purchase but are denied or have a delayed transaction. The FBI will also provide local law enforcement with details of failed transactions, which include delayed transactions, as well as the personal information of rejected individuals. Earlier, firearms dealers only had to provide a purchaser’s state of residence rather than their full address in case of denial or delay."
Well this is nice. A friend of mine is adopted but shares his name with his biological father who is a career felon. So every time he goes to buy a gun, he’s placed on a hold because the system pops up his Dad’s name. Now he, a veteran and law abiding citizen, will have his name given to local law enforcement whenever he tries to buy a gun and is placed on a purchase delay!
Gun dealerships go underground and gives the Mafia grist for their operations.
Sadness.
This person can and should apply to the FBI for a Voluntary Appeals File and obtain a UPIN.
There was a period starting around 2003 for a few years where I had to arrive early for flights because the system apparently popped me on someone else’s name. The first time this happened was at Sanford Airport in Orlando, when I was returning from the Disney Cruise with my ex-wife and stepdaughters. Flight down had been uneventful. Flight back, I give the ticket person my stuff and she gets a big wide eyed look on her face and gets her manager. My wife and I wait over half an hour while my wife is saying “WTF???” They finally cleared us to fly without an explanation. This kept happening for years whenever I flew, and nobody would explain until a nice ticket agent at Reagan National finally said, “Well, were you born in 1958?” Uhhhh, no I wasn’t. Not anywhere near then. But apparently some guy who was born in 1958 shares my name and is a bad actor. So I got popped due to my very common name, and it required a manager to sign off on me to fly and confirm I wasn’t the guy. This finally ended some years later. You’d think the airlines could come up with a system that says “Yeah, this guy wasn’t even born in the same decade as the guy we want.”
This is the administrative state Woodrow Wilson dreamed of.
Philip Dru: Administrator: A Story of Tomorrow, 1920-1935 is a futuristic political novel published in 1912 by Edward Mandell House, an American diplomat, politician, and presidential foreign policy advisor. According to historians, House highly prized his work and gave a copy of Dru to his closest political ally, Woodrow Wilson, to read while on a trip to Bermuda
I tried readin it but I couldn’t.
Thanks I’ll pass it on to him, though he just told me he hasn’t even bought any firearms this year due to the ATF insanity going on.
Does this include the 3 day delay to purchase a handgun in Florida?
If there’s a statutory delay in firearms purchases, I would think it wouldn’t apply to those holds. Only when NICS pops you as a possible criminal.
What happens then, the cops kick his door in?
For those who do not know, a “Delayed Transaction” means anyone who served in the military.
As a former veteran, EVERY time I go to purchase a firearm, I know the approval is not coming quickly. I forget if it’s 3 or 5 days later the FFL can release the firearm to you, if they do not receive a decline from NICS.
Wal Mart, back in the day, were the only ones I knew who would NOT release firearms until they received the all clear, despite being able to legally do so. That said, I don’t know if rural Wal Mart’s even sell firearms any more?
Long gone are the barrels at SEARS full of .22 bolt action rifles for cheap!
It’s been years since I purchased a gun, but I never had a problem. I’m an honorably discharged veteran, and whenever I went to make a purchase in Missouri, I walked right out of the store with my purchase.

I served in the military, and I've purchased several firearms with NICS checks and not once had a delayed transaction.
If you routinely get a delay, it's not because you're a veteran. It's because your name is close to or the same as a known felon in the NICS database.
“...So every time he goes to buy a gun, he’s placed on a hold”
Well, when I moved to Illinois 20 years ago, I applied for a FOID card to make my ownership of my old Mauser K98 legal. My ex-wife applied at the same time I did. My FOID came back from the State Police very quickly. My wife’s FOID was denied due to a “Domestic violence complaint” from 10 years previous. Not a charge. Not a conviction. A complaint....
If someone is denied, maybe they are a felon or illicit drug user, making a straw purchase, or something, even an illegal alien, I would sure hope that that information is shared with law-enforcement authorities, so that that person can be arrested and prosecuted.
I have no problem with actual criminals being reported to police for attempting a gun purchase. I do have a problem with law-abiding gun owners who have an unfortunate name being reported to the police simply for the “crime” of having their purchase delayed due to NICS not being able to differentiate between John Doe the law-abiding citizen and John Doe the dirtbag felon.
Yep
My matches a rather nasty animal rights protestor.
Was told, by NICS, to get a pistol permit as “That will make things easier next time you want to buy a rifle.”
It did.
“This person can and should apply to the FBI for a Voluntary Appeals File and obtain a UPIN.”
He says he attempted that before, but “never got anywhere with it.” He didn’t elaborate.
” I served in the military, and I’ve purchased several firearms with NICS checks and not once had a delayed transaction.”
You served when?
My service pre-dates computer use, starting in 1980’s. Myself and many of my buddies from the same service era, Army, Marines and Navy tell me they have the same experience whenever they buy.
An old FFL acquaintance suggested that would be the reason.
Whatever the reason, and I’ll admit I’ve never asked, it sucks!
That used to be case here in Michigan as well. I got my Michigan CPL, then could just show it and fill out a 4473, no NICS check required.
But then Michigan stopped denying CPLs to people with Medical Marijuana cards and the AFT said that Michigan CPLs were no longer a substitute for a NICS check.
My last few purchases included a NICS check.
If someone is denied...
