By Shiff’s logic a faceless functionary could put the kibosh on a classification. Phooey.

He was the commander in chief which is the highest government official in the country. He would be the ultimate authority in handling information. There is no veto here; not congress or Scotus.
He could issue the order verbally or on toilet paper and it would be valid.

You’re assuming the “Wave of Hand” declassification meets the letter of the law (or is at least a power specified in some fashion in the Constitution).

Maybe. Maybe not. We are all guessing. The problem for Trump is that he has put himself in a position where some judge is going to decide the issue. Not good.

Since the elected President is at the top of the Executive Branch food chain, who gets to tell him, “No, you can’t” when it comes to an executive decision?

You're right. If Democrats had their way every Republican President would have to get permission from a Democrat and 50 OF THEIR librarians.

The whole 'intelligence' structure was created to assist the President of the United State NOT THE OTHER WAY AROUND.

So, what does Schiff’s leaking without process do?
Remember the Obama admin leaking the CIA Afghanistan station chief’s name?

I never post here but the presidential records act says exactly the opposite, the level of ignorance is staggering.

Define a "Presidential record" for purposes of the act.

It's a lot more ambiguous than the law or the opposition suggest. In particular, records or copies of information pertaining to the unlawful investigations of Trump and his campaign could be considered part of his legal defense. That's what they were after, including the bogus classification of the sources of the "dossier" as 'human intelligence" assets that also showed who was behind it.

Seizure of passports or what are clearly personal legal records and tax returns also shows this was another illegal operation by the FBI.
