Federal appeals court reverses ruling on Jan. 6 subpoena to RNC, dismisses case

A federal appeals court has reversed a lower court ruling ordering the Republican National Committee to comply with a subpoena from the House Jan. 6 committee, poking the Democrat-led investigation for vacillating on key issues and acknowledging there were "important and unsettled constitutional questions" about whether the panel is lawfully constituted.

The U.S. Circuit Court for Appeals or the District of Columbia said it was dismissing the case because the Jan. 6 committee withdrew the subpoena to the RNC seeking records of its dealings with a digital fund-raising vendor Salesforce.

"The RNC's appeal has become moot," the appeals court ruled in dismissing the case.

Committee: “Oh, ok then...” [drops the case]

The bottom line is that the Committee withdrew the subpoena and therefore the basis for the appeal is moot. No subpoena, no need to appeal. This is quite common.

Well, for one thing, all the stupid subpoenas they have been issuing left and right would be come worthless.

How could you be held in contempt of an organization that didn't exist?

Every single subpeona, demand, and request by the Jan 6 committee should not be complied with and fully resisted on the grounds that the committee was not properly constituted.

They didn’t want those constitutional issues ruled on, for fear that it would limit their future abuses of power, so they withdrew the subpoena, thereby making the constitutional issues moot in this case.
