Not in the public interest.
A lawyer’s gift.
Not necessary.

Nursing does not pay enough to cover this. Costs will have to go up.

Sure everyone else can be sued why not add another. Now the hospital will need to double their existing malpractice. What a great idea.

Nurses can do harm on their own. I have a friend who was in the hospital and the nurses were doing something wrong and she kept telling them there was something wrong and they just stood there. Luckily for my friend, another nurse noticed what was happening and saved her life by intervening.

I remember back when nurses were saying they should be able to take on more responsibilities, well, with that they need to accept that they are now more responsible.

The issue isn’t that the CRNA operates independently and should be held accountable, the problem is that the physician would now seem to not be the ultimate authority; hence, granting more authority to the CRNA and taking authority away from the physician.

Only if the goal is to destroy healthcare.

Talk about putting someone between a rock and a hard place.

That is such a lose/lose situation for nurses, although, I have found many nurses to be more credible and use better judgment than a lot of doctors. The nurses are doing the on the ground work, so to speak, and see and know what works and doesn't. The doctors don't have that kind of connection to their patients. At least these days.

No doubt in the past they did when they were actually more involved with the day to day care of people, but since that has been delegated to nurses these days, the doctors just don't have that kind of connection.

I also found some doctors to be very condescending and skeptical when I told them something.

I remember that clearly with one doctor I had when I had my MRSA infection. He didn't believe something I told him and he asked my husband at a different time and mr. mm told him the same thing I did. He did back off after that.

Little bit of hyperbole here. CRNAs have always been held liable for their care & RNs/nursing staff can be named in lawsuits. This isn’t new

Until she went into management, my wife was a Critical Care Nurse for 25 years, split more or less evenly between California and North Carolina. She’s had malpractice insurance from the day she passed her boards. She also refused bad orders fairly frequently.

Lol you never fail to take a swipe at advanced practice nurses.

The CRNA in this story was part of an anesthesia care team and if you actually both to read the article you’ll see that an anesthesiologist, you know -one of those highly educated superior beings - was present.

Your bias does not do much for your credibility

Well worth the time to read the full legal briefing. In a nutshell, the evolving development of independent autonomy and authority of nurses with advanced training and expertise, eagerly sought by members of the profession, comes with an evolving level of responsibility and independent liablility. The 1930’s era defense of “following doctors orders” was examined and found to be outdated given the material changes in roles and status over the decades.

One can disagree of course, and one judge did dissent; but this was a carefully researched and reasoned decision.

Advance practice nurses have a place with careful supervision. But if you want to say you have the knowledge and experience to practice independently then you have the judgement and experience to be responsible for what you do…. You don’t get to have the cake and eat it too.

I have been in practice as a CRNA for almost 20 years. There is nothing new here although practice can vary by state.

Both the anesthesiologist and CRNA are liable as they both acting inappropriately by doing an inhaled-sevoflurane induction on a child with cardiomyopathy. My guess is the CRNA was sued along with the hospital as some CRNAs are hospital employees, not independent providers or employees of physician groups.

But generally speaking nurses can and have been named in plenty of lawsuits. The writer of the nurse for org story doesn’t exactly have her facts straight & is indeed using a lot of hyperbole

YES!

A friend who is a doctor will tell you of the nurse that saved a patient’s life and his ass.

As an intern on every busy night attempting to catch a few winks between incoming patients...

A nurse knocks on his door and tells him accident victim ...

He gets up and tells the nurse to start a glucose solution...as he looks at the chart...

The nurse says “she is diabetic”... “SHE IS DIABETIC!!!”.
As he was waking up.

He said this could have caused great harm or even killed the patient.

At a top-of-the-line major Chicago hospital.NWM

Also one of many reasons to avoid emergency rooms if possible.

I do practice independently and I do carry my own liability insurance

At no point ever did I say, imply, or insinuate that I wanted to have responsibility without liability.

Your post, however, implied that a patient was harmed because a CRNA was involved in the case, and that had the care been provided by an anesthesiologist, the outcome would have been different. You conveniently left out the 800 lb gorilla in the room which was that this induction was medically directed by an MD.

Both of these providers were inappropriate in the care of this child & exercised very poor judgement. Both should be held liable.

Maybe it’s like the military, you must follow all orders unless they’re unlawful orders. If you follow an unlawful order, you partake in the liability.

There are plenty of positions in the military that the line is drawn at the lower ranked individual: loadmaster, transportation joint inspector, security forces.

They have to flag and disobey unlawful orders more often than one might think.

No, most of them don’t. Medical malpractice insurance for doctors is big money. Probably more than most nurses make in a year. Nurses can get malpractice insurance but that’s only because they are currently not normally targeted by litigation. Once that changes, they won’t be able to afford it and no one will want to become a nurse anymore.
