“Insurance companies are generally smart enough to have clauses saying they don’t cover damages when you are found to have violated the law.”

They generally do not cover CRIMINAL violations of the law. The whole purpose of liability insurance is to cover CIVIL violations.

Even then they don’t cover gross negligence on your part, and this kind of case would seem to fit the bill.
