In order for the injured to win, they will have to show fraud. Which in this case should not be hard. And they will have to demonstrate that the 3rd party company designed to insulate the drug companies to legal responsibility will have to be exposed as part of the fraud. But, Yes, this is going to be one for the record book. Never in the history of the world has anything on this scale taken place. We are totally in uncharted waters.
I don’t think fraud will be difficult at all. The amount of people involved will produce lots of communications when subpoenaed.
