Judge blocks North Dakota’s trigger abortion ban

A judge blocked North Dakota’s trigger abortion ban on Wednesday, allowing the state’s sole remaining abortion clinic to continue offering the procedure following the Supreme Court’s decision to overturn Roe v. Wade.

North Dakota’s ban makes it illegal for an abortion to be performed in the state unless it’s necessary save the patient’s life. Exceptions are also made in cases of incest or rape, according to The Associated Press.

So, SCOTUS rulings are mere opinions to lower ranking judges?

Wish I could have done this back when I was in the military.

Another rogue leftist judge.

Even though traitor Roberts told us “there’s no such thing as an Obama judge or a Trump judge.” They’re all just perfect little angels issuing perfect, unbiased rulings that can’t be questioned.

The quickest way out of this is for the North Dakota Attorney General to re-issue the certification. Then its done in 30, and the judge can kiss off.

The Chief Justice has no power to remove any Federal Judge. The only way they can be removed is death, resignation or impeachment by the House and conviction by the Senate.

Wrigley took that step on June 28, but plaintiffs in the case argued that he acted prematurely and that it takes 25 days after the Supreme Court’s opinion for the court to hand down an official judgement.

The Court officially ISSUED the judgement today, so that argument is now void.

U.S. Constitution, Article 3: “The Judges of both the Supreme and Inferior courts shall hold their offices during good Behavior...”

This means they hold their offices for life, unless they are impeached by the House and convicted by the Senate. Nowhere in Article 3 gives the Chief Justice the power to remove a Federal Judge.

President Lincoln and congress redrew the congressional districts with the Judiciary Act of 1862. They added more districts in the north and consolidated them in the south, breaking the Democrat majority of judges.

If there is no district, judges don’t have a job. Except for the Supreme Court Congress controls how many judges there are.

Yes, but of course the Judiciary Act of 1862 was passed during the Civil War with Representatives and Senators from the South not present to vote on it. That said, I don’t think eliminating the district eliminates the Judges’ salaries. Again, to quote Article III:

“The Judges, both of the supreme and inferior Courts, shall hold their Offices during good Behaviour, and shall, at stated Times, receive for their Services, a Compensation, which shall not be diminished during their Continuance in Office.”

Judges hold the office for life barring resignation or impeachment. Alcee Hastings received his Judge’s salary while he was in prison.

All that said, Democrats currently control the House, which is tasked with impeachment and they will not lose enough seats in the Senate to allow the removal of any Federal Judge who favors their policies.

The bottom line—we’re stuck with them.
