Actually,with only a handful of exceptions,almost everything is a states rights issue.
Constitutionally it should be, but alas, notwithstanding the 10th Amendment it no longer seems to be. It is interesting that 100 years ago it was thought necessary to amend the Constitution to allow the federal government to ban alcohol, yet now the Federal government can menthol cigarettes and no one seems to question where the Constitution provides Congress with that power.
