Florida’s 15-week abortion law blocked, then quickly reinstated

A Leon circuit judge on Tuesday blocked Florida’s 15-week abortion law, declaring it a likely violation of the Florida Constitution, but his decision was quickly overturned because of a state appeal.

The appeal by the state’s attorneys automatically reversed Judge John Cooper’s injunction and reinstated the law. The First District Court of Appeal likely will be the next stop for the case, which Gov. Ron DeSantis has vowed to take to the state Supreme Court.

The law bans most abortions after 15 weeks of gestation, with no exceptions for rape or incest. Violators could face up to five years in prison. Doctors and other medical providers could lose their licenses and face fines of $10,000 per violation.

Last week, Cooper said he would block the law, but he delayed the decision until he could issue the written order. That allowed the law to go into effect as planned on Friday.

In his ruling Tuesday, Cooper wrote that the law “likely violates the Privacy Clause of the Florida Constitution.”

He called the state’s arguments that the law “promotes public health and welfare by protecting maternal health and children in utero” were “legally insufficient and factually unsupported.”

“The Court concludes that [the law] will lead to some women who would have obtained abortions after 15 weeks being required to carry their pregnancies to term instead,” Cooper wrote. “[The law] would undermine maternal health for these women by subjecting them to the increased health risks presented by carrying their pregnancies to term.”

Due to the high college population, Leon County is a lib stronghold. Another Leon judge blocked the FL Congressional redistricting plan a few weeks back and promptly got reversed by on appeal in a sharply worded opinion that criticized the Leon judge. Same thing will happen here.

The era of judges deciding which laws are real laws and which laws are just recommendations by legislatures needs to end.

There is no medical reason this shouldn’t be
changed to 6 weeks. You have instant pregnancy
tests to let you check if your pregnant.

15 weeks is arbitrary not based in science.
Better to do it earlier easier and safer.

As I understand it, at 15 weeks, the procedure requires the mother be dilated and the baby's head crushed to pass the birth canal. Prior to 15 weeks it is something less barbaric.
