Florida judge blocks 15-week abortion ban set to go into effect Friday

A Florida judge has temporarily blocked a ban on abortions after 15 weeks that was set to begin Friday.

Planned Parenthood, the American Civil Liberties Union and abortion providers filed suit to stymie the law, arguing that it violated the state’s constitution.

Leon County Judge John C. Cooper handed down his ruling from the bench after two days of arguments and said he would issue a written injunction.

State officials are expected to fight the decision.

Florida Gov. Ron DeSantis signed the 15-week abortion ban this past April, prior to the Supreme Court’s momentous reversal of Roe v. Wade last Friday.

Florida might just get a new Constitution written by conservatives. Liberals might end up in a much worse place in Florida.

Just ignore him and enforce the law; this judge has no power to overrule the legislature and the Supreme Court.

Here’s the difference. The Dobbs Decision removed the Federal courts from the abortion question and handed it back to the States.

Now the battle front moves to State laws and State Constitutions for State Courts to decide. I seriously doubt there’s anything in the Florida State Constitution enshrining abortion rights. That doesn’t mean some liberal State Court judge won’t make one up.

But I expect that PP will eventually lose this suit. And even if they win the Florida Legislature will quickly correct that.

I don't think the Florida Constitution mentions the word abortion.

Going from memory . . . the pro-abortion group claims that about 1989 the Florida courts voted to say they had found language in the state Constitution that protected women's right to abortion.

A lot has happened since then. For one thing no one knows what is meant by the term “woman.”

And today's Florida Supreme Court is not the court appointed by Lawton Chiles. No justice on the court today was appointed by a Democrat, although three were appointed by Charlie Christ before he showed out.

Governor DeSantis has appointed three of the seven current justices during his first term.

Net: the Florida Supreme Court is thought to be reliably conservative on the matter of giving unborn children the death penalty.

Get ready for 50 separate Roe v. Wade decisions, state courts blocking state laws based on penumbras and emanations from 50 state constitutions.

I just looked at the state constitution. Abort and abortion are not in there. Looked up medical, there are references but nothing about abortion. Nothing about reproduction either.

Those of us who are now parents of 30 year olds who want to argue over abortion curbs, find such arguments on their part to be ludicrous and rude when taken up by the child?

How can a state 2nd judicial circuit court judge issue a restraining order to a state law that applies to outside of his circuit?!? If this leftist judge thinks a Florida law is unconstitutional in his circuit, a judge in another circuit could just as easily declare the law to be constitutional with in his circuit.
