The accounting at the top of the case is misleading. Roberts wrote that he would not overturn Roe or Casey, and that he would continue to find a right to abortion in the constitution. How that is labeled “concurring” is one of the magic’s of law. Call it a legal fiction if you will. Count me in agreement, I disagree.
