Because the decision was 6-3. Roberts went with the majority vote, but he wrote his own opinion, rather than signing on to Alito's opinion.

Wow. That is pathetic. And the idiot Bush had to make this wussy "Chief Justice" right from the start. HE should have wrote the opinion and put his stamp on it.

And by writing a concurring opinion, Roberts was able to delay publication of the majority opinion as long as possible. That was no accident. Roberts was placed on the court by Bush to subvert traditional values which most modern conservatives embrace, while he pretends to support them.
