But at the very least, NO PARDONS for the ones who smeared their feces on the wall in Statuary Hall, and the hallway leading from there to the Rotunda.
The President can preemptively pardon people who haven’t been arrested or indicted yet. Well, there is a little debate on the matter, but at least Gerald Ford got away with it.

True, that could be a problem, but it’s a gray area that hasn’t thoroughly been tested in the courts. Governors have issued blanket pardons or clemencies before, without specifically naming everyone who is qualified to receive it, so there is some precedent there.
Carter issued a blank pardon for draft dodgers without mentioning names. Trump could tailor the pardon to those charged with non-violent crimes or crimes not related to property damage, leaving those who actually attacked Capitol Police or trashed the building to be punished. Or he could pardon them all and deal with the consequences.
