Diogenes Lamp #11] There is no justice in DC. They seldom bother charging a Democrat with anything, and even when they do, they let them go.

Dr. Simone Gold, MD, JD, is also an attorney. She raised $430,000 for her legal defense, didn't file a single motion, and pleaded guilty. Pleading guilty to a misdemeanor may save her medical license or law license (if any).

If she ignored police commands to leave Statuary Hall (as was alleged) she would have had a difficult time maintaining she was innocent. She would have had little chance of a defense succeeding, and a certain significant expense. As a lawyer, she may have seen that escaping with minimal damage and expense, and without a trial record, was the best she could do.

[Thread article] She pleaded guilty in March to a misdemeanor charge of unlawfully entering and remaining in a restricted area of the U.S. Capitol during the Jan. 6 attack.

D.C juries have found convictions for the same or similar charges in other cases. Balancing the expense of contesting the case, the evidence, and the possible downside, Dr. Gold apparently chose to plead to the misdemeanor count.

Prosecutors said Gold hasn’t shown remorse or accepted responsibility for her actions. They accused her of trying to profit from her crime, saying America’s Frontline Doctors has raised more than $430,000 through its website for her legal expenses.

“It beggars belief that Gold could have incurred anywhere near $430,000 in costs for her criminal defense: after all, she pleaded guilty — in the face of indisputable, readily identifiable evidence — without filing a single motion,” prosecutors wrote in a court filing.

“I can certainly speak to the place that I was, and it most emphatically was not a riot,” she said. “Where I was, was incredibly peaceful.”

But prosecutors say she entered the Capitol immediately after a law enforcement officer was assaulted and dragged to the ground in front of her. Gold also joined a mob that was trying to break into the House chamber and later ignored police commands to leave Statuary Hall so she could finish giving a speech, according to prosecutors.

Why can’t conservatives file a class action lawsuit for different treatment under the law?

In DC? It will get instantly dismissed.

Many legal people pride themselves on the notion that the law is fair, justice is blind, and all are treated equally under the law.

One need only look at the treatment of the DC rioters in 2020, or Sussman, to see that this is not so.

Someone posted a comment from some South American dictator the other day. It went something like this.

"For my Friends, everything! For my Enemies, the Law!"

A system of law that plays favorites is not really a system of law.

Then it appears no system of law is possible anuyplace where people are involved.

That conclusion does not follow from the available evidence.

What is clear is that the law in Washington DC plays by unwritten aristocracy rules, but this is not the same thing as saying it is impossible to create a system of law that will work.

It's just clear that the one in DC doesn't work. (Nor does it work well in many other places.)

I had an epiphany several decades ago. I had heard on the news that a man who had been serving 20 years in prison had been exonerated by DNA testing.

Upon hearing this news, I asked myself a simple question.

If a man absolutely, and provably did not commit a particular crime, how is it possible to "prove" that he did?

Well it isn't. Not in reality.

Since then i've seen many instances of something proven in court, that is absolutely incorrect in reality.

In science, if a process continuously yields incorrect results, it is tossed out, and another process is found which will yield better and more consistent results.

But our legal system is much like science or medicine. It runs on the inertia of the past with change heavily resisted by the ranks of the existing practicers.

Max Planck once remarked "Science progresses one funeral at a time."

Our legal system doesn't even do that.

There has to be a solution to this! ( I know, I know, ….approaching the “third box”) I wish we could think of some way to get justice reinstated in this country though, before it comes to that!
