H.R.2377 Federal Red Flag Gun Confiscation Passed in House

On April 8, 2021, Representative MCBath sponsored  H.R. 2377, a federal bill to authorize extreme risk prevention orders or “red flag” law.

Using the recent mass murders in Buffalo, New York and Uvalde, Texas, as an emotional springboard to push passage of the law, Nancy Pelosi has pushed through the passage in the House of Representatives today, 9 April 2022. The vote was 224 to 202.

The most recent and comprehensive study on the Red Flag law in California showed no measurable effect on assault or fatal violence against others or self for an intensely covered four-year period, 2016 to 2019.

The Congressional Budget Office’s description of the bill is sparse. From cbo.gov:

H.R. 2377 would allow family members and law enforcement officials to file petitions in federal courts requesting extreme risk protection orders (ERPOs) for the removal of firearms from people who are believed to present an extreme risk of harm to themselves or others. The bill would require the U.S. Marshals Service (USMS) to serve federal ERPOs, remove firearms if so ordered, and store firearms until a hearing can be held to determine whether the firearms should be returned to or kept from the respondent for a specific period.

The actual text gives much more problematic detail. The timing required is extremely fast, giving the judge little ability to determine how credible the alleged threats are. With the supposed dire consequences for failing to grant a petition, it seems very few would be denied.

Ex parte means the accused is not present. From the bill:

“(c) Ex parte orders.—

“(1) TIMING.—

“(A) IN GENERAL.—Except as provided in subparagraph (B), a court that receives a petition for an ex parte Federal order under subsection (b) shall grant or deny the petition on the date

HR 2377 may give us insight into what can happen with the Red Flag part of the proposed package in the Senate.

For example, the House version requires a judge to make a decision on a Red Flag petition the day it is delivered to them.

Or, if delivered very late, the next day.

In Indiana, it is also the Prosecuting Attorney that has to push the Red Flag charges. The Fedex shooting in Indianapolis was a failure by the PA. A mentally disturbed kid killed 8 people and the authorities knew all about him.

Great...just great. We have an insane family member, brainwashed liberal who will call other family members in:

those of us who loved Trump
those of us that thinks 2020 was stolen from us
those of us that didn't take the clot shot....

Gonna have to do something about that.....self-preservation comes to mind. Hopefully the Russians nuke Portland before she can act.

I see no such statement in the link to HR2377 provided.

It says the “court” decides. In the event of an “emergency” (see sect D), the flag can be thown immediately, which means when cops show up to the court after hours they get a rubber-stamping magistrate not a judge. Almost all red flag cases wind up being handled this way.

Note there’s a provision in there to put these federal red flag claims into the national criminal database.

Good luck keeping your CC permit. Many states rely on the appearance of your name to revoke your permit.

Prepared to fight or be disarmed by the left wing doxxing community who accuse you based on a post they don’t agree with.

If this is a Federal law it would require a massive new federal police force to field red flag complaints. The senate version would provide funds to states to create their own red flag laws.

There’s a book I read recently ( easy read) titled ‘ By Dawn We’ll Be Free’ by Georgette Hadvina. A not so well known book but should be read by anyone who loves freedom. She was born in Hungary and escaped to America. She spends a lot of time on red flag laws. Friends, family, neighbors, teachers turning each other in for the most ridiculous suspicions.
