Courts have, on other issues, refused to look behind the curtain. Anything a majority in Congress does is considered done according to rules. The de facto sessions situation, wehre they fake meet, is taken as meeting, quorum present, etc. “Legal fiction.”
I am sure he will someday in this case. He is being brave because his case could shootdown the who committee essentially. He will lose all the way up but possibly win in the USSC. That’s my guess at least.
