AUSTIN, Texas (AP) — Forty years after the U.S. Supreme Court upheld the right to a public education for all students regardless of legal status, Texas Gov. Greg Abbott says that decision is another longstanding precedent worth challenging.
Here’s what to know:
WHAT WOULD TEXAS CHALLENGE?
The requirement that public schools teach all children was affirmed by a 1982 ruling in a case known as Plyler v. Doe. The 5-4 decision struck down a Texas law that sought to deny enrollment to any student not “legally admitted” into the country.
WHAT DID ABBOTT SAY?
Abbott said the crux of the argument would be that the federal government should foot the bill amid the high numbers of migrant crossings.
WHAT’S BEEN THE RESPONSE?
Immigration rights advocates, Democrats and the White House bristled at Abbott’s remarks.
One of the groups behind the Plyler case, the Mexican American Legal Defense and Education Fund, said Abbott was trying to inflict harm the court sought to avoid decades ago.
WHAT’S NEXT?
Abbott gave no timeline of when or how Texas might bring a new challenge. Any new law drafted by Republicans would have to wait until 2023, when the state Legislature returns.

You are all over the place. We should not be educating non citizens. They are a burden that is overwhelming the system by leftist design. Throwing money at the problem of trying & failing to educate children who don’t speak the language, don’t have the basics and who have no right to be here is wrong headed. As wrong headed as trying to bail a boat with a sieve.
Children of American citizens deserve the right to have an education that allows them to gain proficiency and become productive citizens. They are the ones being cheated by leftists zealots more interested in slogans than people.
They are the ones your method will continue to condemn to illiteracy.
The math & science schools are being destroyed by the people who look for equal outcome rather than equal opportunity. Where will new discoveries come from when those schools are dumbed down and the more able students are selected against to provide a pretense of opportunities to students who cannot succeed? As in Procrustes’ bed the able need to be crippled so the less able can measure up.
I think there's plenty of evidence people get better jobs when they're educated. It may even allow them to get a more skilled job, make some money and pay more taxes.
But is that a job that would otherwise go unfilled if that person didn't take it, or are they simply taking a job opportunity that might have otherwise gone to a citizen or legal immigrant? Because if it is the latter, then all you are doing is shuffling wealth rather than creating it.
The all too common scenario is that the illegal is taking the job at a lower wage rate that the employer otherwise would have to pay. That is great for the owners and higher management of business who benefit from, but amounts to wage depression for those citizens and legal immigrants who are otherwise competing for those jobs.
In any case, these are all worthy policy discussions that voters should be having rather than having had it taken out of their hands by an activist Supreme Court.
Public schools in my area have a 12% proficiency rating.
It's high time to privatize education.
Do you think letting all these kids remain uneducated and not learning the language is better for our society? It isn't like they're just going to disappear if we ignore them.

Railing against our societal challenges doesn't help anyone.
And having a bunch of uneducated kids running around is worse - it actually holds us back.
They need to go back to their native lands. Why do you ignore that fact? You are right we should not ignore them we should return them to the authorities in their native lands.
The education system is not working throwing more money at it will not help. It is idiocy to do the same thing over & over when it has failed.
In any case these children are not our responsibility. We cannot feed, clothe, educate the entire world. The policy of accepting the impossible burden of limitless illegal border crossers has drawn more and more illegals to the US.
It is rank stupidity to take more into a leaky lifeboat. There will be no more America if this continues.
I don't ignore it, but you thinking they "they need" to do something doesn't make it happen.
The illegals here and for now they're not leaving. Given that, what's the best thing for our society?
I'm pretty sure it isn't a bunch of uneducated illiterates running around.
The best thing for our ‘’society’’ is to close the f’ing border!!
That's not what happened in OK several years ago when they passed a volley of anti-illegal immigration laws. Untold thousands of them left the state on their own when officials cracked down on transporting, hiring, housing, or spending any state funds on services for illegals.
I own a wheat farm in OK, and I actually got a letter explaining how my state income taxes WENT DOWN after those laws were passed.
I’m pretty sure that throwing money at schools will not make them educated.
That was the point of the links. Throwing all the illegals into schools only means that American children don’t get an education either because the level is lowered for everyone.
This is what happens when you create an attractive nuisance by giving free education, housing medical care, food stamps, a phone & living allowance.

You don't think having a bunch of uneducated illiterates in the community lowers the quality of that community?
Yes. That is why they need to be deported. You are making a mistake in logic. Having a bunch of uneducated, undocumented illegal aliens of all ages lowers the living quality of a community. Putting the children that are part of that segment through our schools will not change that fact one iota.
Don’t concentrate on some “feel good” “sounds noble” solution.
Strike at the root of the problem. The educational system is on a downwards spiral despite spending ever increasing sums. The children you are advocating for are increasing the rate of decline for all children.
We have not discovered a way to improve education with money. What we need is a return to accountability and the stripping of liberal indoctrination which has replaced traditional educational material. We need to limit schooling to American citizens and concentrate on basics not ESL. No use advocating for unworkable practices, like bringing in an endless supply of illegal alien children, that exacerbate the problem you want to fix.
