A California First District Court of Appeal decision released on Monday ruled that a ban against four drug dealers from a 50-block area of the Tenderloin and South of Market neighborhoods is illegal, upholding earlier rulings on the matter.

In hundreds of pages of charging documents, the DEA says it has cracked two drug trafficking rings run by Honduran nationals who were based in Oakland and selling in San Francisco's Tenderloin.

Tried to work with them through the legal system and failed. Will just have to shoot the illegal SOBs then.
So they are trying to ban them from the area, because arresting them for drug dealing does no good?
Is it more productive to prosecute trespassing?
California is insane, normal people should flee while they can.
The case, The People v. Padilla-Martel, stemmed from an action by former San Francisco City Attorney Dennis Herrera and the City of San Francisco two years ago. In 2020, authorities had a hard time culling rampant drug use in the Tenderloin area of the city. Needing a new way to keep out a few dozen drug dealers who were responsible for a large percentage of drug dealing in the area, Herrera sued 28 of them that September from entering a 50-block area of the city. As most had several drug dealing priors, and all but one living outside the city, the city thought they had a strong case for public safety. The Tenderloin still is an epicenter of drug dealing and overdose deaths in the city.
Sorry, but I agree with this ruling. You want to control drug sales in an area, ARREST, CONVICT, AND INCARCERATE DEALERS TO THE FULLEST EXTENT OF THE LAW.
Clearly, the city knew who to target for enforcement, but banning anyone from free travel through public streets is not constitutional.
So Honduran illegal alien drug dealers have Constitutional protections? Who knew?
So you can sue Honduran illegal alien drug dealers in civil court? Who knew?
Amusing to realize just how prescient were the themes in the “Dirty Harry” movies. The politicians and academics did contortions to protect the criminals, they were aided by subservient, pole climbing “senior police officials” and in the end if there was to be any true justice, it came out of a barrel of a gun. Everything has come to pass as such in California except their is no justice whatsoever in any manner.
If the Feds were really serious about wanting to put them in prison they would charge them with being Trump voters and part of the Jan. 6 so-called “insurrection”.
No evidence necessary.
Just accuse them under the Patriot Act, throw them in the slammer and be done with it.
According to this, the legal geniuses of San Francisco decided that the best way to deal with known alien drug dealers is to get a court order to keep them out of a part of the city, instead of, I don’t know, arresting them, imprisoning them and/or deporting them. Yep, we’ll get a restraining order, that’s the ticket!
I’m heading to the Tenderloin today to work. . .I go in once a week now. Sigh. Perhaps the ruling will be appealed.
It’s what desperate citizens do when their sheriff the local direct Constitutional officer won’t take action
“Your mouthwash ain’t cutting it.”
I’m just a regular guy little knowledge about legal machinations but clearly the DA office is on the Honduran payroll.
Sobering. Taxes are lower in GA.
