Title 9 was written with the biological definition of sex. Not the mental issue symptoms.
But without a biologist, judges such as Ketanji Brown Jackson just have no idea how to define what a male person or a female person really is. So we have to somehow find some clues to whether one is male or female, in order to administer laws which deal with sex discrimination.
