The agreement between Schumer and McConnel requires that the Filibuster be available in the case of the vote by the Judiciary for confirmation be tied. It’s a matter of public record. Look it up.
They’ve already voted, with 3 GOP votes, to move her nomination to the full Senate. Since they’ve dropped the filibuster on SCOTUS justices it’s over.
