Make it a “special circumstance” enhancing the penalty. Which, for murder, should be the chair or a suitable substitute.
I disagree, I would find him NOT GUILTY and push for the Charges being DISMISSED Outright. The Politicians created this and the Police Departments across this State have Willfully Gone along with their demand to SHIELD ALL ILLEGAL ALIENS.
As far as I am concerned, ANY Public Employee that suffers an Injury or Loss of Any kind at the hands of a person KNOWN to be in the Country Illegally, Got what they deserve. THEY MADE THIS CHOICE and deserve to pay the price for their decisions.
