WASHINGTON — The House committee investigating the Jan. 6 attack on the Capitol on Tuesday laid out its theory for potential criminal charges against former President Donald Trump, arguing before a federal judge that he and conservative lawyer John C. Eastman were involved in a conspiracy to perpetrate a fraud on the American public as part of a plan to overturn the 2020 election.
The allegations, which the committee first leveled against the men last week in response to a lawsuit filed by Eastman, could determine just how deeply the panel can dig into emails, correspondence and other documents of lawyers close to Trump who have argued that such material should be shielded from scrutiny because of attorney-client privilege.
They also form the core of the panel’s strategy for potentially holding Trump and his allies criminally liable for what happened on Jan. 6, 2021, one that turns on the notion that they knowingly sought to invalidate legitimate election results.
“We’re talking about an insurrection that sadly came very close to succeeding to overturn a presidential election,” Douglas N. Letter, the general counsel of the House, told Judge David O. Carter of the U.S. District Court for the Central District of California, during arguments in Eastman’s case.
The House committee’s argument is a risky one. If Carter were to reject its claims, the inquiry’s legal team would be less likely to win support for a criminal prosecution unless investigators unearthed new evidence.
Central to the case is the argument that, in repeatedly rejecting the truth that he had lost the 2020 election — including the assertions of his own campaign aides, White House lawyers, two successive attorneys general and federal investigators — Trump was not just being stubborn or ignorant, he was knowingly perpetrating a fraud on the United States.

Did they mention anything about why the FBI had hundrends of undercover agents at the Capitol on January 6th?
Or why these agents were doing everything possible to force Trump supporters into the Capitol?
Why would the FBI conduct an operation to force American citizens to commit crimes?

I think they are committing fraud along with the Adam Schiff committee, the FIB and most MSM. Republicans that want to play hard ball have a target rich environment. The RINOs are accomplices to the treason and coup attempts. Play hard ball!
Shouldn’t the American people know the names of these FBI agents?
Shouldn’t we know who organized the January 6th fedsurrection?
Wouldn’t the Jan 6th committee have to actually prove that the election was legitimate, not just say it was?
How much are all these January 6th lawsuits filed against Trump by Congressional members costing the US taxpayers?

U.S. judge dismisses claims that congressman incited Capitol riots

WASHINGTON (Reuters) -A federal judge on Wednesday dismissed civil claims against Republican Representative Mo Brooks alleging he helped incite supporters of former President Donald Trump’s to attack the U.S. Capitol in January 2021, saying Brooks’ speech to the crowd was constitutionally protected free speech.
The ruling by U.S. District Court Judge Amit Mehta represents a setback for U.S. House of Representatives Democrats, including Eric Swalwell, who last year filed the lawsuit against Trump and his allies alleging they encouraged the crowd to storm the Capitol on Jan. 6, 2021, as Congress met to formally certify Democrat Joe Biden’s 2020 election victory over Trump.
Mehta in February had dismissed claims against several of Brooks’ co-defendants, including former Trump adviser Rudy Giuliani and Trump’s eldest son, Donald Trump Jr. But in that ruling, Mehta said he would allow the plaintiffs to continue to pursue their claims against the former president.
Trump, he determined, was not immune from the three lawsuits filed by Democratic members of Congress and two police officers over his actions on Jan. 6, 2021, because his fiery speech to supporters was not within the scope of his official presidential duties.
Trump, shortly before riots, repeated to the crowd of supporters his false claim that the 2020 election had been stolen from him through widespread voting fraud, telling them to go to the Capitol and “fight like hell” to “stop the steal.”

Jan 6 panel give me a break what a waste of my tax dollars.
This should not have the ghost of a chance. A president, convinced of his case, and talking about it with his lawyer, is not defrauding anybody. There are people who are sure Trump is mistaken, but even that should not be a crime. If being wrong is a crime every sad sack in Washington would be in jail.
Congress does not have the authority to “hold people criminally responsible”
That’s called a Bill of Attainder and it is forbidden by the Constitution.
If people repeatedly try to break into my house and I later find that something is missing, I might reasonably conclude it was stolen.
Of course a tidy house loving lady friend might have thrown it out.
Major efforts were made by Democrats to undermine election security procedures. These efforts led most Republicans to believe contests were stolen. I have not seen enough evidence to conclude that enough states were stolen to shift the outcome to Biden, but there is no way of knowing for sure.

AGAIN!!! Congress cannot criminally prosecute ANYONE.
They will drag this out and try to charge him in 2023 or 2024. Close to election time.
I was gonna say that a bunch of congress-critters have an abundance of nerve by accusing ANYBODY on the planet of fraud. That is their main schtick.
