Illinois Appellate Court Dismisses Pritzker's Appeal, Blocking State From Enforcing Mask Mandate in Schools

An Illinois appellate court rejected Gov. J.B. Pritzker’s appeal of a lower court's ruling against a mask mandate in schools, writing the request is “moot” because the governor’s emergency COVID-19 rules already expired.

The highly-anticipated decision from the three-member panel of the Illinois Fourth District Appellate Court was published just before midnight Thursday.

In their decision, the appellate court justices wrote there is no “actual controversy” to decide.

“Because the emergency rules voided by the TRO are no longer in effect, a controversy regarding the application of those rules no longer exists. Thus, the matter is moot,” the justices wrote.

The justices also wrote, “We note the language of the TRO in no way restrains school districts from acting independently from the executive orders or the IDPH in creating provisions addressing COVID-19.”

The decision by the appeals court hinges on a bipartisan legislative committee’s vote earlier this week not to renew Pritzker’s emergency rules, which first took effect in September 2021.

On Tuesday, lawmakers who serve on the Joint Committee of Administrative Rules voted to temporarily suspended the school mask mandate, with three Democrats crossing over to vote to halt the measure.

On Feb. 4, a Sangamon County judge issued a temporary restraining order that blocked the state from enforcing the rules that called for mask mandates and other COVID restrictions in schools.

While the state appealed the judge’s temporary restraining order, the rules expired on Feb. 13.

At this point, it's unclear whether the Illinois Department of Public Health is able to issue another mask-related mandate for COVID protocols in the classroom.

Illinois will lift the indoor mask requirement, with several exceptions, by Feb. 28 if state COVID metrics continue to decline, Pritzker announced last week. The governor noted, however, that the eased mandate would not apply to school settings.

"School outbreaks impact hundreds, even thousands of people across a community – and there are a whole lot more infections when districts are maskless," Pritzker said in a press conference last week.

That fat hypocrite sent his family off to Florida even as he imposed COVID restrictions on Illinois.

The whole school-mask issue demonstrates how "public" schools, like the entire state of Illinois government, are simply owned by the teacher's unions and other public employee unions for whom the rest of us a just tax-paying serfs.

Finally some co mon sense starting to break through. 2 docs were on discussing how this whole,idiotic Pandemic nonsense was mishandled right from the start by frightening themasses unnecessarily by telling them they were all gonna die if they caught covid. The discussed how the survival rate was so,high that the fear mongering was unnecessary, and how al. They had to do was help protect the elderly and sick folks with multiple comorbities.

They also,pointed out the obvious again that kids do not die from covid. The risk,is so small it is essentially zero

That's been disproven with multiple studies showing face diapers do nothing to stop the spread of COVID-1984 and may actually do worse when spreading other contaminants because such masks are meant to be replaced regularly throughout the day.

When one mask is worn all day, it's a petri dish of bacteria.

Interesting bit of circular logic: the legislature committee rejected a bill to reinstate the emergency powers 9-0 because they said it was now up to the court. The court says since there’s no legislation, the issue is moot. Typical democrat response - so them credit for removing what they previously claimed credit for putting in place.

Anyhow, Prickster loses which is the important thing.

The schools will maintain the mandates. The board members on these boards are often teachers beholden to the unions.

Putzker is not done - The Circus Elephant Governor is taking this case to the Illinois Supreme Court.

The Chicago Democrat news reporters were in tears being forced to broadcast a Putzker defeat.

While the outcome may have been good, I am sick and tired of the courts not doing their job. The issue is NOT MOOT, because the scumbag can just impose restrictions again whenever it suits his fancy. We need courts to start recognizing that we are sovereign individuals, and are not simply wards of the all-powerful state.This should have been struck down for being incompatible with a free people.
