A Pennsylvania court just overturned the state’s mail voting law — but expect appeals

A Pennsylvania court struck down the state’s mail voting law Friday, saying the state Constitution requires voters cast ballots in person unless they meet specific requirements.

That almost certainly won’t be the final word on the matter, as the state will likely appeal to the Pennsylvania Supreme Court, triggering an automatic stay of that decision and leaving Act 77 in place while the high court considers the case. And Democrats believe the Supreme Court, which has a Democratic majority, will ultimately uphold the law.

Democrats had feared for months that the state’s Commonwealth Court, with its Republican majority, would strike down the 2019 law.

The court notably did not rule against the merits of mail voting and its expansion. It focused instead on how that expansion occurred, saying that change must take place through Constitutional amendment, not legislation.

“No-excuse mail-in voting makes the exercise of the franchise more convenient and has been used four times in the history of Pennsylvania,” the court wrote in its opinion. “Approximately 1.38 million voters have expressed their interest in voting by mail permanently. If presented to the people, a constitutional amendment… is likely to be adopted. But a constitutional amendment must be presented to the people” before legislation like Act 77 can take effect.

The decision was three to two, with three Republican judges striking the law over the dissent of two Democratic ones.

The law, which passed with widespread bipartisan support in 2019, became politically toxic on the right after Joe Biden’s 2020 victory in Pennsylvania. Some conservatives blamed Trump’s loss on expanded mail voting and criticized Gov. Tom Wolf’s administration’s implementation of the law, saying the executive branch overstepped its authority. Republicans also blasted court decisions, such as one that allowed mail ballots to be counted up to three days after the 2020 election so long as they were postmarked by Election Day.

Republicans first brought a lawsuit alleging Act 77 was unconstitutional in the immediate aftermath of Trump’s 2020 defeat. They unsuccessfully sought to invalidate millions of mail ballots.

Legal procedure to remove illegally-seated officials, or officials caught in criminal acts, is a quo warranto ('by what authority'). Courts are out of it due to the plenary powers granted in the US Constitution between state and federal legislatures to determine election rules and results. A court can rule that election laws were broken or not, as in this case, and whether a fraud occurred, but final resolution rests with the legislatures. An example is the actions taken after our Civil War in denying states seats in Congress for a time. Today's problems are not from a Confederacy of states, but from a political party that should be de-certified for its lawlessness.

The quo warranto needs to be filed in a fed district court requesting the removal of PA's U.S. Senators(D), and its Representatives 8(R), 6(D) until such time as a valid fed election is held in PA.

Why yes, it does end Pelosi's reign as Communist-in-charge of Congress.

Problem one has with this judicial victory it is a foregone conclusion the highly politicized Dem majority Pa supreme court will overturn it,

The sad thing is that now laws are ultimately no longer being decided based upon the Constitution of the United States, but by the party in power at the time based on feelings. How many weeks does our country still have as the land of the free, home of the brave?

If Governor Wolf wasn’t a democrat trying to protect the democrat’s right to cheat in elections, they would let the court ruling stand. Governor Wolf will not for obvious reasons. If anybody has ahy question about the fact that they cheated in the 2020 election, watch how Wolf handles this.

The last line of the story is odd. “Unsuccessfully” means that it in the minds of those who wrote the story, it doesn’t matter if the event was Unconstitutional and the offices obtained illegally. That means that in the future, as “long as you get away with it” it doesn’t matter what the law is.

The Pennsylvania Supreme Court will "uphold the law", or change it completely, or allow it to be ignored or enforced in a manner Democrats see fit. Whatever the situation calls for, just like they did in 2020.

PA Supreme Court was actively part of the 2020 steal do not expect this hack body to actually follow the law or constitutions of the state or the federal

Also in delaware county alone there where recorded 29K more mail in votes than mail in voters recorded in the SURE system. Statewide Frank Ryans’s audit has around 400K more. Let’s make sure the democrats can steal the elections in the future Mr. Corman and Mr. Mastriano. Let’s vote for act 77 even tho we know it is unconstitutional.

This battle should have been aggressively fought TWO YEARS ago by republican-controlled state legislatures when the cheat-by-mail-in ballots first came into existence.

But we all know why it wasn't. Those legislatures were populated with RINOs who wanted Trump gone.
