The Federal Government has decided to cancel Novak Djokovic’s visa because it was “in the public interest to do so”, casting serious doubt over whether the 20-time grand slam champion will compete in the Australian Open.
Last week’s decision to cancel Djokovic’s visa was overturned in the Federal Circuit Court on Monday, but Federal Immigration Minister Alex Hawke still had the final say on whether the world No. 1 is allowed to stay in the country.
Hawke was tasked with choosing whether the 34-year-old was a risk to the health and safety of the Australia community, but “lengthy further submissions” from Djokovic’s legal team delayed a decision.
And Hawke finally came to a decision on Friday afternoon, invoking his discretionary power and immediately seeking to deport the tennis star.
“Today I exercised my power under section 133C (3) of the Migration Actto cancel the visa held by Mr Novak Djokovic on health and good order grounds, on the basis that it was in the public interest to do so,” Hawke said in a statement.
“This decision followed orders by the Federal Circuit and Family Court on 10 January 2022, quashing a prior cancellation decision on procedural fairness grounds.
“In making this decision, I carefully considered information provided to me by the Department of Home Affairs, the Australian Border Force and Mr Djokovic.
“The Morrison Government is firmly committed to protecting Australia’s borders, particularly in relation to the Covid-19 pandemic. I thank the officers of the Department of Home Affairs and the Australian Border Force who work every day to serve Australia’s interests in increasingly challenging operational environments.”
Djokovic’s lawyers are expected to seek an immediate injunction which would allow him to stay and play his first round of the Australian Open pending an expedited trial next week.

It has to do with border security - and, yes, he is endangering that. Apparently the legal issues surrounding that are too complicated for a lot of people to understand, but I do understand Australia's border security laws and policies. And this case does endanger them.
The core of Australia's border security is a simple principle. We decide who comes to our country and the conditions under which they arrive. We decide. On any grounds we like. Nobody else gets to tell us what to do in this regard.

The Victorian government behaved idiotically by not being clearer that the exemption they gave Djokovic wasn’t intended to be used for entry to Australia.
And I believe the Immigration Minister has probably behaved idiotically by waiting until 6pm on Friday night to issue his decision - he really should have done it earlier.
But, in general, all the federal government has done is seek to ensure Australian border law is applied in its normal fashion.

Because Djokovic received incorrect information, you think “he is a danger to Australia’s border security”.
No. That isn't my position at all.
The primary reason he's become a danger to border security is because of the decision made by the Judge on Monday, that basically overturned Australian federal border policy. Unfortunately, unless the Judge reverses that decision (or a higher court does) the only practical way the federal government can take back control of that policy is to take action that invalidates the Judge's ruling.
The secondary reason is that allowing Djokovic to stay overturns the fundamental principle of our border policy - that the Australian government absolutely has the power to decide who comes here and under what circumstances, and that nobody else can make that decision, and that no exceptions are made.
Most of this isn't Djokovic's fault - although the fact he lied (and he has admitted doing so) on his border entry form, does mean I can't say none of it is.

Filling a boring government form wrongly after getting incorrect information and quickly admitting it is something forgettable to normal people. It’s irrelevant. You’re a clown.

Allowing him to stay under current conditions does put Australian border security at risk. If those conditions changed slightly, that wouldn't be the case and I am hoping they do.

I assume he is healthy. This isn't about that and people assuming it is, are missing the point and misunderstanding what is going on.
He was asked if he’d travelled anywhere else in the last 14 days. He lied and said he hadn’t. It was a simple Yes/No question.
That has nothing to do with the confusion over his vaccination standard. On that question, I accept he’d been given misleading information about a fairly complex issue.

Your repeated assertion of that non-fact means that you yourself are a deliberate liar.
And of course, Djokovic is NOT being deported because of that error on a form by his agent, but because he is a good example of remaining healthy without toxic vaccines.

To lie is to deliberately, not negligently, provide false information. Djokovic has stated that his agent negligently checked the wrong box on a form, and you have repeatedly lied about it and called it a lie.
Perhaps such negligence should be a deportable offense, but Mr. Hawke evidently doesn’t think so. The reason he gave for cancelling the visa was the inspiration Djokovic gives to anti-vax Australians.
This matter has changed my attitude toward Australia. I now think the USA should not be allied with Australia. When China comes calling you should defend yourselves if you can without any American help. As far as I can tell the human rights differences between Australia’s governments and the CCP are too small to care about.
