Terrible headline. It's not the mere fact that employees wear BLM masks that violates the First Amendment. It's that the DOL forcing Whole Foods to permit employees to wear those masks in contravention of a neutral rule prohibiting saying of any kind on masks.
So in essence, employees are making politic statements to customers during working hours, and the DOL says Whole Foods must permit that.
I hope WF keeps fighting that.
Where I worked you couldn't wear any thing with writing....especially that which made a political statement. You'd be sent home to change if you did.
