Novak Djokovic legal papers claim Home Affairs cleared ‘quarantine-free arrival’ (and why that claim may be inaccurate)

Novak Djokovic’s legal team revealed a letter clearing the player to enter the country, but the document may not be the “rubber stamp” they think it is.

The plot has continued to thicken in the Novak Djokovic visa saga as his legal team claims the world No. 1 had received word from the Department of Home Affairs that he had met “the requirements for a quarantine-free arrival into Australia”.

However, the claim appears to refer to the Australian Travel Declaration which is an app travellers can use to give an indication of whether they will be allowed into Australia based on information provided by the traveller.

The app does not validate whether the passenger has a valid visa, travel exemption or provide approval for entry into Australia.

I'm posting this article, which I believe is behind a paywall, unfortunately, because I've seen people sharing other articles claiming Djokovic has some sort of valid entry document from the Australian government. From the submission we have seen from his lawyers, which names that document, it would seem to be the one described in this article and if it is, it does not constitute anything like what his lawyers are claiming.

All he would have had to do to get this document is say he had a valid exemption from vaccination. He wouldn't have been required to provide any proof at that time. Because the intention is that he would provide that proof when he arrived in Australia.

The idea is to allow people who do have documents to prove a valid vaccination exemption to get on a plane without having to visit an Australian embassy or consulate before leaving whereever they are. It relies on people telling the truth - with the understanding if they haven't told the truth, that will be identified in Australia.

It is possible Djokovic did not understand this, especially given he seems to have been given inaccurate information by Tennis Australia, in which case, he may have honestly believed he was entitled to enter Australia. But that doesn't mean he was.

Please understand, I don't support vaccine mandates except in a very limited number of cases (frontline healthcare workers working with vulnerable populations). I don't believe there is any medically or scientifically valid reason for Djokovic to be denied entry to Australia.

But I also believe very strongly that the Australian government has a right to impose any conditions on non-citizens to enter Australia. This is a matter of Australian Border Security, and Australian sovereignty. And you don't get to break them just because you do not like them.

The core problem here is the existence of vaccine mandates, which is a very real problem. But those are determined by state governments, not the Commonwealth government, which has no power to overrule the states on these issues.

this story ain’t over yet. Tiley stated early on that there were 26 applications for exemptions, and only a ‘HANDFUL’ were approved.

then we had the Czech tennis player Renata Voracova dragged into the story, as if she and one of her entourage were the ‘HANDFUL’.

CLEARLY THERE ARE MORE PLAYERS INVOLVED.

Novak Djokovic’s situation seems dire, but a legal expert has detailed three questions the government might struggle to answer.

“Mr Djokovic was granted a visa on the assumption that all the legal requirements had been met,” Mr Rizvi told The Project on Thursday evening.
“The government is now saying all the legal requirements had not been met.

“The second layer is when the person boards an aeroplane to come to Australia – there are Australian Border Force officers there who can prevent a person boarding an aeroplane to Australia if there are issues with the visa. Now, that was only some 24-48 hours ago, I understand, and yet no action was taken to prevent Mr Djokovic boarding.”

Mr Rizvi said action only took place at the “third layer of protection”, at an Australian airport. He warned Djokovic’s case would set a dangerous precedent that will “create enormous amounts of chaos at Australian airports and as international travel ramps up”.
“That is the last layer at which the protection should be applied,” he continued...

“If I were Mr Djokovic‘s lawyer, there would be three questions I would be asking,” he said.

“The first question: ‘If my client had not met all of the legal requirements for a visa, why did you grant him a visa?’

“The second question I would ask is: ‘If you had concerns about my client’s visa, why did you not cancel that visa prior to him boarding a plane to Australia?’

“The third question I would ask is: ‘Given that you granted my client a visa, and none of the circumstances prior to grant have changed since that time, on what basis can you cancel that visa?’”...

The Australian government is a clown show. It’s main purpose in life is to make other governments look competent in comparison.

The only logical ending for this comedy would be for Djokovic to be granted an interim injunction against deportation until the case is fully adjudicated; then he will win the championship, and then lose the court case and be deported! Australian immigration police will seize him at Rod Laver Arena clutching the champion’s trophy! LOL

That wouldn't surprise me. If a mistake was made once, it could have easily have been made more than once. Whoever made the mistake.

I don't agree. I think most people overseas just don't understand the difference between the Australian government and the state governments. And they think the Australian government is schizophrenic because they don't understand is what they are seeing is nine different governments all with different policies and ideologies.

I wish it was just the Australian government. The Federal government is actually one of the sane ones - but they have to deal with the crap that Victoria, Western Australia, and occasionally Queensland keep throwing at them.

We have to hate him… If Novak is not the devil, then we are all fools – fools for acquiescing to increasingly nonsensical demands and fools for agreeing to endlessly shifting Covid goal posts...

At least our Federal government is conservative and not trying to put in vaccine mandates like your Federal government is trying to do. Hopefully, your Supreme Court will save you.

Too many on FR do not try to understand the issues and just take for granted about how other countries are organized. And they do not do hardly any research. They just look at some blog and take it for truth. You would think that conservative folks wouldn’t believe everything they read on the internet.

Australia has been seized by some of the same democratic spirit that gripped France in 1794. Back then they beheaded the country’s greatest scientist, Anton Lavoisier. In 2022 you just want to deport the world’s greatest tennis player, all in the name of democratic equality. No one bothers to mention that the vaccine your government requires is dangerous and doesn’t even work. In a spirit of democratic equality everyone must suffer equally, both the stupid and the wise.

I actually do hope he gets to play. I don’t like the fact that he may knowingly have illegally breeched our borders, but there is enough ambiguity about that that I suspect sorting it out is likely to take some time, and if that is the case, I hope the courts issue a ruling that allows him to play pending appeal. Even if he doesn’t meet the standard for entering Australia, he does actually have a valid exemption to play in the tournament - that’s where the confusion is. Different standards of exemption. If he’s here let him play.
