A lawmaker who sponsored the original bill said violent novels the shooter penned could have been enough for a judge to grant an extreme risk protection order.

A man who was feared by his colleagues, was on the radar of law enforcement, and who had written novels laying out in detail how the main character would kill people — naming some of the people he would eventually kill on Monday — wreaked havoc across Denver and Lakewood.

So how was Lyndon James McLeod able to get a gun? Authorities have not released details about the weapon he used, but they collected at least one following the rampage that left five people dead. Security footage and witnesses suggest it was a long gun.

In 2019, Colorado passed a red flag law, which allows family members, co-habitants, and police to ask a judge for what’s called an extreme risk protection order, or ERPO. The order can be used to remove guns from someone who is a threat to themselves or others.

Courts in Denver and Las Animas counties, where the gunman most recently lived, and in Jefferson County, where he was known and ultimately died after being shot by police, said they have no record of an ERPO filed against him. The Jefferson County Sheriff’s Office would not confirm whether McLeod had a concealed carry permit in the county, and citing the holiday, the Denver Department of Public Safety said Thursday it would not be releasing information about the gunman, including whether the agency ever considered filing an ERPO against him.

State Sen. Brittany Pettersen, a Democrat from Lakewood, was one of four lawmakers who sponsored the red flag bill.

She said the law absolutely could and should have applied in this case, since she characterized McLeod as a threatening person who...

I think red flag laws are designed more for women to harass their husbands (future ex-husbands), and aren’t really intended for public safety. At least, that’s how they’re used.

No! Red f,ag laws are only used against innocent people without a violent bone in their body. The purpose of red flags laws is not to stop criminals, but for the left to falsely accuse innocent people on the right ofe of being a danger to society, so that commie supporting cops in li beral areas can swoop in and remove their guns. The left can’t confiscate guns on a national level via any of the other 40, 000 p,us gun laws,on the books apparently, so,they needed a way to go after law abiding citizens gun owners

The left woild never go after criminals over red flag laws because they woild be too afraid of offending gheir base, znd facing lawsuits- so the only reason. For red flag laws is to harass and deny ,aw abiding citizens who typically don’t file suits, their second amendment and Inalienable rights

This guy and the Boulder King Sooper's shooter could easily been prevented if "Red Flag" was ever used as advertised.

"Red Flag" is more a tool for political persecution than for public safety.

*BINGO* Write or display something against an apparatchik in a ruling regime and watch how fast that works. As for protection of the general public I doubt anyone could name a single instance where tragedy was avoided by use of this "law".

That’s ridiculous. I write, A LOT, and big surprise: They contain violence, considering they’re set in wartime. I imagine someone would use that against me even though I’ve never threatened anyone, because IL has these laws, too.

Absolutely stupid.
